Patrick Leahy (D-Vt.) fired off a round of letters renewing his demand for testimony from Karl Rove and White House Chief of Staff Joshua Bolten. The Senate Judiciary Committee chairman sent a letter to White House Counsel Fred Fielding asking whether the two officials will agree to testify in light of today's ruling against the Bush administration's blanket claim of executive privilege. The investigation at issue is the allegedly political firings of eight U.S. attorneys. The Senate committee issued subpoenas in June and July 2007 for Bolton and Rove to testify on Capitol Hill. "Today's decision renders the grounds for Mr. Bolten and Mr. Rove's refusal to comply with the Committee's subpoenas moot," Leahy wrote in the letter to Fielding. Leahy also sent a terse letter to Attorney General Michael Mukasey asking whether he planned to rescind the legal memos based on the theory of blanket executive privileged that the judge dismissed today. Please advise me by no later than next Thursday, August 7, when you will withdraw the erroneous [Office of Legal Counsel] opinion from Stephen Bradbury relied upon by the White House to justify its non-compliance with congressional subpoenas since that opinion has been repudiated by the court. In addition, please inform me whether the court's decision will cause you to re-evaluate your memos and those from [Office of Legal Counsel] in support of overbroad and unsubstantiated executive privilege claims not only in the U.S. Attorneys investigation, but also in other matters, like the claims used to block Congress from investigating warrantless wiretapping, the leak of the name of undercover CIA agent Valerie Plame for political retribution, and White House interference in the Environmental Protection Agency's decision-making. Which of these do you now intend to withdraw? Leahy sounds like he's asking for a complete surrender in this ongoing battle over White House officials' testimony. But there's a lot of litigation still to go in this case. ------ End of Forwarded Message ------ End of Forwarded Message From yamagata at virtual-markets.net Tue Aug 5 09:10:31 2008 From: yamagata at virtual-markets.net (G Richard Yamagata PhD) Date: Tue, 5 Aug 2008 09:10:31 -0700 (PDT) Subject: [Davis Democrats] FINAL Agenda for Davis Democrat Club Board Meeting on Tuesday August 5, 2008 Message-ID: <200808051610.m75GAVfW038364@mail.afes.com> Campus Democrat Officers, PLEASE ATTEND IF POSSIBLE. Instead of spending time listening to their constituents, they are in Washington staging phony "sit-ins" and playing games with America's pocketbooks. At a time when Big Oil profits hit historical highs, Republicans in Washington are blocking bills that would help ease the price of gas for people across California and the country. But don't just believe me--conservative commentator Bob Novak in his Evans-Novak Political Report said: "Republican rejection of a Democratic offer to allow four specific GOP amendments (including one on drilling) signaled that Republicans might prefer abusing the Democrats for preventing votes to actually voting on drilling." Instead of voting to help ease the crunch Americans are feeling due to soaring gas prices, Republicans - fueled by Big Oil's $13.5 million in campaign contributions to their coffers this cycle alone - continue to play games with the American public and allow oil executives to line their pockets with record profits. Big Oil must think that Americans can't see through the smoke-and-mirror games they push their pocketbook-puppets to play in Washington. Their cronies continue to oppose common sense plans to lower the price of fuel and expand the use and production of renewable energy. Jerry McNerney is leading the fight for those common sense solutions . He's called on the President to release oil from the Strategic Petroleum Reserve, which would lower prices at the pump immediately, and to stop price speculation and stabilize the markets - which the President refuses to do. He is pushing to force Big Oil to use the millions of acres of land they already have access to but refuse to drill on! I have news for Big Oil and their Washington Republican puppets: WE CAN see through the games. WE CAN see Republicans obstructing sensible policies. WE CAN see the link between Big Oil contributions and flawed Republican energy ideas. Together, WE CAN make a difference. This weekend, we are "knocking and talking" during our district-wide Day Of Action. We need help from friends and neighbors far and wide to show Big Oil that the American people will not sit back and accept Republicans making a mockery of both process and policy. Join Jerry in standing up to Big Oil ! We are going door-to-door across our district this weekend to share with our neighbors and voters the smart policies Jerry continues to fight for to help lower gas prices and ease the crunch so many across California are feeling. It takes a lot of resources to organize such a large Day Of Action. Please consider donating $40, $60, $100 - whatever you can generously give - to we make sure we have enough supplies for all our friends walking across the district on Saturday. Our teams of neighbors are ready to knock on thousands of doors across the district. Will you join them and spread the word about Jerry ? Sincerely, Alex Posorske Campaign Manager McNerney For Congress PS - The best way to get the truth out to voters is by talking with them one on one. We need you to do that! Please help us by walking with us this Saturday or by making a small donation to help us continue. Time to finish them off To view this email as a web page, go here. Pick up the New York Times this morning and read the headline: "Book on Obama Hopes to Repeat Anti-Kerry Feat." Yes, Jerome Corsi, the right wing fringe author who made his bones smearing the Catholic Church and lying about my military record, is back atop the best seller list with an anti-Obama book chock full of lies. If your blood isn't boiling yet, read this: "This is a fact: Today Barack Obama is subject to what is probably the greatest concentrated attacks of smears, lies and innuendo in the lifetime of anyone who reads these words." Those are the words of Brent Budowsky in Editor and Publisher. He knows what he's talking about. And it's not just Barack: up and down the ticket and all across the country, the rightwing smear machine is ramping up attacks on Democrats. We've seen this movie before. The Republicans, without ideas, start running a negative campaign filled with personal attacks and misleading ads. The attacks get condemned, but they get lots of attention and get played on TV endlessly. We've got to fight every way we can. I'm going on television and the radio pushing back every chance I get - just like I did on MSNBC a few days go - but I need your help. Click here to watch that clip on MSNBC and sign up to our new, grassroots project to beat back the rightwing machine wherever it operates! TruthFightsBack.com We're launching a new website that empowers you to fight back across the country in ways no campaign has attempted. It's called TruthFightsBack.com, and we can use all the help you can give. By signing up, you'll stay on top of what the rightwing is doing and help fight for the truth. And you can report smears when you see them to keep us on track on what the smear machine is up to at every moment. You will be our eyes and ears. We know the game, we've learned some things, and we have a fired up movement of activists like no party has had in decades, all networked together with great Internet tools. So sign up to help. This is a massive undertaking, so we need your help to pull it off: TruthFightsBack.com You can't just play defense against smears, pointing out how they aren't true. You've got to play offense, too, exposing the whole cynical game for what it is: an attempt to keep us from talking about the real issues and ultimately changing our country for the better. The Republicans have nothing to run on, no ideas to push, no solutions for America. They'll run a campaign of laughable gimmicks and outright distortions and lies. But we can fight back with the truth - and the truth can win this time. Let's do it. Thanks, John Kerry Paid for by John Kerry for Senate. I personally am in shock. She was a fighter and we were told that she had a good chance of living another 4 weeks. So, I am not ready for this. Where others would have given up a year ago, Mary Lou lived each day in very high spirits, with a positive outlook and optimism that would not be dampened. It was always a joy to see her walking with her husband around town. She was very happy to be alive each day. If you wish to send a card or word of condolence to her family, their mailing address is: The Hernandez Family (Husband is Ernest) 933 Craig Place Davis, CA 95616 She will be greatly missed by all, especially the DDC Board. Mary Lou appeared in the Ice Cream Social picture in the Enterprise last year and had attended the event, helping Betty Wier with welcoming people at the door. She was a very hard worker at events, like the Yolo County Booth and Davis Campaign Headquarters, and very outspoken at meetings. I personally am very saddened by her death. I am hoping that Mary Lou will be remembered at the Ice Cream Social with a minute or two of silent meditation or prayer. Please also remember Julia Sanchez, who was Mary Lou's close and dear friend. They worked together in all club activities and joined the DDC board together. They were so close, that they seemed to be telepathic and seemed to know what the other was thinking. I thought that they were sisters for years and was shocked to learn that they were not. This disturbing report reminds us that LGBT people continue to be targets of bias-motivated violence while the law continues to fail them. The law does not provide federal officials with the law enforcement tools that they need to prosecute these crimes for what they are -- bias-motivated hate crimes -- and it does not provide local law enforcement with the resources that they need to prosecute hate crimes at the state and local level. Barack Obama has made strengthening and expanding the federal hate crimes law a priority. ? As a United States Senator, he co-sponsored the bill that would expand hate crimes protections to include crimes based on sexual orientation or gender identity. The bill also would provide local law enforcement agencies with federal aid in fighting and prosecuting hate crimes. ? He cast the critical 60th vote that prevented the bill from being defeated by a Republican-sponsored filibuster. [2007 Senate Vote #350] ? He has pledged to continue his support for enacting these protections into law if elected President, promising earlier this year to ?place the full weight of my administration behind the enactment of the Matthew Shepard Act to outlaw hate crimes... on the basis of sexual orientation and gender identity.? [New York Blade, 6/10/08] ? He has pledged to reinvigorate enforcement of all hate crime laws at the Department of Justice's Criminal Section. [www.barackobama.com] While Barack Obama has been fighting to expand hate crimes protections, John McCain has been standing in the way. He has consistently stood in the way of the bill becoming law. ? He voted against the hate crimes bill in 2000. [2000 Senate Vote #136] ? He voted against the hate crimes bill in 2002. [2002 Senate Vote #147] ? He voted against the hate crimes bill in 2004. [2004 Senate Vote #114] ? In 2007, he was the only member of the Senate to not cast a vote at all on the bill. [2007 Senate Vote #350] President Bush has threatened to veto hate crimes legislation, and John McCain is promising to yet again follow in his footsteps on an issue important to the LGBT community. Last year, Damien Skipper lost his brother Ryan in a brutal hate crime. Ryan, just 25 years old, was beaten, stabbed and killed just because he was gay. Ryan?s family has since become forceful advocates for expanding the federal hate crimes law, and they support Senator Obama in large part because he is committed to passage of a federal hate crimes law. Damien recorded the following clip and wanted to share it with others: http://www.youtube.com/watch?v=ePGsAU-LxSE Expanding and strengthening hate crimes protections is just one of the many issues important to the community where Barack Obama stands with LGBT people and John McCain has turned his back. Share Damien?s story, and your own support for Senator Obama, by forwarding this message to five friends who might still be undecided about who to vote for in November. Why I Will Not Vote > for John McCain > > > > Why I Will Not Vote for John McCain > > Phillip Butler | March 27, 2008 > As some of you might know, John McCain is a long-time acquaintance of mine > that goes way back to our time together at the U.S. Naval Academy and as > Prisoners of War in Vietnam. He is a man I respect and admire in some ways. > But there are a number of reasons why I will not vote for him for President of > the United States. > > When I was a Plebe (4th classman, or freshman) at the Naval Academy in > 1957-58, I was assigned to the 17th Company for my four years there. In those > days we had about 3,600 midshipmen spread among 24 companies, thus about 150 > midshipmen to a company. As fortune would have it, John, a First Classman > (senior) and his room mate lived directly across the hall from me and my two > room mates. Believe me when I say that back then I would never in a million > or more years have dreamed that the crazy guy across the hall would someday > be a Senator and candidate for President! > > John was a wild man. He was funny, with a quick wit and he was intelligent. > But he was intent on breaking every USNA regulation in our 4 inch thick USNA > Regulations book. And I believe he must have come as close to his goal as any > midshipman who ever attended the Academy. John had me "coming around" to his > room frequently during my plebe year. And on one occasion he took me with him > to escape "over the wall" in the dead of night. He had a taxi cab waiting for > us that took us to a bar some 7 miles away. John had a few beers, but forbid > me to drink (watching out for me I guess) and made me drink cokes. I could > tell many other midshipman stories about John that year and he unbelievably > managed to graduate though he spent the majority of his first class year on > restriction for the stuff he did get caught doing. In fact he barely managed > to graduate, standing 5th from the bottom of his 800 man graduating class. I > and many others have speculated that the main reason he did graduate was > because his father was an Admiral, and also his grandfather, both U.S. Naval > Academy graduates. > > People often ask if I was a Prisoner of War with John McCain. My answer is > always "No - John McCain was a POW with me." The reason is I was there for 8 > years and John got there 2 ?? years later, so he was a POW for 5 ?? years. > And we have our own seniority system, based on time as a POW. > > John's treatment as a POW: > >> >> 1) Was he tortured for 5 years? No. He was subjected to torture and >> maltreatment during his first 2 years, from September of 1967 to September >> of 1969. After September of 1969 the Vietnamese stopped the torture and gave >> us increased food and rudimentary health care. Several hundred of us were >> captured much earlier. I got there April 20, 1965 so my bad treatment period >> lasted 4 1/2 years. President Ho Chi Minh died on September 9, 1969, and the >> new regime that replaced him and his policies was more pragmatic. They >> realized we were worth a lot as bargaining chips if we were alive. And they >> were right because eventually Americans gave up on the war and agreed to >> trade our POW's for their country. A damn good trade in my opinion! But my >> point here is that John allows the media to make him out to be THE hero POW, >> which he knows is absolutely not true, to further his political goals. >> >> 2) John was badly injured when he was shot down. Both arms were broken and >> he had other wounds from his ejection. Unfortunately this was often the case >> - new POW's arriving with broken bones and serious combat injuries. Many >> died from their wounds. Medical care was non-existent to rudimentary. Relief >> from pain was almost never given and often the wounds were used as an >> available way to torture the POW. Because John's father was the Naval >> Commander in the Pacific theater, he was exploited with TV interviews while >> wounded. These film clips have now been widely seen. But it must be known >> that many POW's suffered similarly, not just John. And many were similarly >> exploited for political propaganda. >> >> 3) John was offered, and refused, "early release." Many of us were given >> this offer. It meant speaking out against your country and lying about your >> treatment to the press. You had to "admit" that the U.S. was criminal and >> that our treatment was "lenient and humane." So I, like numerous others, >> refused the offer. This was obviously something none of us could accept. >> Besides, we were bound by our service regulations, Geneva Conventions and >> loyalties to refuse early release until all the POW's were released, with >> the sick and wounded going first. >> >> 4) John was awarded a Silver Star and Purple Heart for heroism and wounds in >> combat. This heroism has been played up in the press and in his various >> political campaigns. But it should be known that there were approximately >> 600 military POW's in Vietnam. Among all of us, decorations awarded have >> recently been totaled to the following: Medals of Honor - 8, Service Crosses >> - 42, Silver Stars - 590, Bronze Stars - 958 and Purple Hearts - 1,249. John >> certainly performed courageously and well. But it must be remembered that he >> was one hero among many - not uniquely so as his campaigns would have people >> believe. > > John McCain served his time as a POW with great courage, loyalty and > tenacity. More that 600 of us did the same. After our repatriation a census > showed that 95% of us had been tortured at least once. The Vietnamese were > quite democratic about it. There were many heroes in North Vietnam. I saw > heroism every day there. And we motivated each other to endure and succeed > far beyond what any of us thought we had in ourselves. Succeeding as a POW is > a group sport, not an individual one. We all supported and encouraged each > other to survive and succeed. John knows that. He was not an individual POW > hero. He was a POW who surmounted the odds with the help of many comrades, as > all of us did. > > I furthermore believe that having been a POW is no special qualification for > being President of the United States. The two jobs are not the same, and POW > experience is not, in my opinion, something I would look for in a > presidential candidate. > > Most of us who survived that experience are now in our late 60's and 70's. > Sadly, we have died and are dying off at a greater rate than our non-POW > contemporaries. We experienced injuries and malnutrition that are coming home > to roost. So I believe John's age (73) and survival expectation are not good > for being elected to serve as our President for 4 or more years. > > I can verify that John has an infamous reputation for being a hot head. He > has a quick and explosive temper that many have experienced first hand. > Folks, quite honestly that is not the finger I want next to that red button. > > It is also disappointing to see him take on and support Bush's war in Iraq, > even stating we might be there for another 100 years. For me John represents > the entrenched and bankrupt policies of Washington-as-usual. The past 7 years > have proven to be disastrous for our country. And I believe John's views on > war, foreign policy, economics, environment, health care, education, national > infrastructure and other important areas are much the same as those of the > Bush administration. > > I'm disappointed to see John represent himself politically in ways that are > not accurate. He is not a moderate Republican. On some issues he is a > maverick. But his voting record is far to the right. I fear for his > nominations to our Supreme Court, and the consequent continuing loss of > individual freedoms, especially regarding moral and religious issues. John is > not a religious person, but he has taken every opportunity to ally himself > with some really obnoxious and crazy fundamentalist ministers lately. I was > also disappointed to see him cozy up to Bush because I know he hates that > man. And he is a man that I am proud to call a fellow POW > who "Returned With Honor." That's our POW motto. But since many of you keep > asking what I think of him, I've decided to write it out. What you and Barack have accomplished over the past 19 months is incredible, and it's an honor to be part of it. I'm looking forward to rolling up my sleeves and getting involved. I recorded a short video message about how I hope to help in the weeks ahead. Please take a minute to watch the video and share it with your friends: Over the next few weeks, I'll be doing a lot of the things you've done to grow this movement -- reaching out day after day in neighborhoods all across the country, connecting with people who are hungry for the change we need. This is no ordinary time, and this is no ordinary election. I plan to do everything I can to help Barack take back the White House. I don't need to tell you that John McCain will just bring us another four years of the same. You can't change America when you supported George Bush's policies 95% of the time. Barack has the vision and the courage to bring real change to Washington. But even he can't do this alone. Join me by getting involved in your community -- and reach out to your friends and family to get them involved as well.
